Thursday May 13, 2004 at 7:00 p.m. the regular Middlebury Township Board meeting held at the Ovid Municipal Building was called to order by Supervisor Anthony Sinicropi with the pledge to the flag. Prayer was given by clerk Audrey Sovis. Sinicropi, Sovis, treasurer Carolyn Stevens, trustees Charles Simpson and Paul Dutton were present. There were ten visitors. Kevin Bodensteiner of MMPA gave an update on the current status of the high impact area of Krouse and Warren roads and discussed an ordinance proposed by the county of Shiawassee that would require wells in that area to be at least 85 feet deep. Kelly Wagner of Charter Communications addressed the issues of poor cable reception in the Middlebury area. She reported that there has been a proposal to upgrade this system and include internet service at an approximate cost of $400,000. They are still waiting word from their corporate offices on this issue. Stevens commented that the township has not received the last payment from Charter as promised. Wagner said she would look into this matter. Carol Vaughn and Joe Borgstrom from the Owosso Chamber of Commerce. request that Middlebury contribute one dollar per resident towards economic developement. Sovis explained the board recently learned that the township would not be in compliance with the law to contribute tax payer monies without a contract. Vaughn will send a contract for the board to review. No decisions were made. Jim Capitan reported that the racetrack is in total compliance with all rules and regulations imposed upon them including the $6000 bond they must post. He also reported that the county budget is in fair to good shape. A motion was made by Dutton seconded by Simpson to approve the agenda with the addition under unfinished business of buying a flag and stand. All ayes. Carried. A motion was made by Dutton seconded by Simpson to approve the minutes of the April 8, 2004 regular board meeting. All ayes. Carried. A motion was made by Sovis, seconded by Stevens to pay the May bills in the amount of $2,104.76 with an additional check written for an improvement CD for $10,000. (Checks 1186-1207). Roll call vote: Ayes Simpson, Sinicropi, Stevens, Dutton, Sovis. No nays. Carried. A motion was made by Simpson, seconded by Dutton to approve the treasurer’s report. Roll call vote: All ayes, no nays. Carried. Gene Paez of the Shiawassee County Health Department came and again talked on the subject of the high impact area near Krouse and Warren roads. He requested the township send a letter to him confirming that we have been updated on the current status of this situation and have been informed of the proposed ordinance. Sinicropi reported that Ovid Township plans to change their fire ordinance in regard to the billing process. In the future, it is expected that Middlebury will no longer pay quarterly bills, but will pay one dollar per resident annually. A motion was made by Dutton, seconded by Simpson to purchase a flag and stand to be used by the Middlebury township board at the Ovid Village hall. Roll call: All ayes, no nays. Carried. Sexton Howard Magee gave the board a cemetery report including the request of a few new rules and publishing them in the paper. He also commented on the urgent need for at least 42 foundations to be replaced and the need to fasten the rules on a permanent surface at the cemetery so they cannot be taken down.
