Thursday June 10, 2004 at 7:05 p.m. the regular Middlebury Township Board meeting held at the Ovid Municipal Building was called to order by trustee Charles Simpson filling in for supervisor Anthony Sinicropi who was absent. Also present were clerk Audrey Sovis, treasurer Carolyn Stevens and trustee Paul Dutton. There were 7 visitors. The pledge to the flag and prayer was given by Simpson. Kevin Hehrer, a scout from Troop 585, expressed to the board his desire to put up a fence and sign at the Middlebury Cemetery in order to earn the rank of Eagle Scout. There was discussion of the estimated cost and his intent to get as many supplies donated as possible. Dutton made a motion for the approval of Hehrer doing this project and, if needed, the board would give up to $500 for this improvement. Seconded by Sovis. Roll call: Simpson, Sovis, Stevens, Dutton all ayes. No nays. Sinicropi absent. Carried. Bill Kline inquired about the status of fixing the Worden Garber bridge on Warren road. Dutton reported that the county was waiting on the contractor who did the job of replacing this bridge. Dutton will again inquire with the county. A motion was made by Dutton, seconded by Simpson to approve the agenda. All ayes, no nays. Carried. A motion was made by Simpson, seconded by Dutton to approve the minutes of the May 13, 2004 board meeting. All ayes, no nays. Carried. A motion was made by Sovis, seconded by Dutton to accept the treasurer’s report. All ayes, no nays. Carried. A motion was made by Dutton seconded by Simpson to pay the bills for May in the amount of $16,608.91 (checks 1208-1231). Roll call: All ayes, no nays, Sinicropi absent. Carried. It was reported by Sovis that the townhall now has a new (used) fire file and that a fax machine was purchased and is available to the board for township use. Simpson read letters from David Chrenka, Shiawassee Co. Code Enforcement Officer. The first in regard to the Betty Metz trailer at 9003 W M-21 Ovid, giving notice that legal action will now be taken by the county regarding the abandoned structure. The second letter was in regard to the violation of an unlicensed vehicle at the residence of Verne Rogers at 6476 W. Dewey road Ovid. The board discussed the Chamber Foundation and their request for money from Middlebury to invest in economic development in Shiawassee County. Sovis reported that she took the contract presented by the Foundation to Demis and Wenzlick Accounting. Jim Demis felt that the contract was legally sound. After discussion was made on the matter of budget restrains and how much Middlebury directly benefits from this investment, Stevens made the motion that the board contract $500 with the Economic Development Partnership. Simpson seconded. Roll call: All ayes, no nays, Sinicropi absent. Carried. Stevens presented five proposals for the 2004-2005 tax year. Upon review the board moved on the following: Sovis made a motion that the township collect 1% administration fee as was done last year, Dutton seconded. Roll call: All ayes, no nays, Sinicropi absent. Carried. Dutton made a motion that no partial payments will be accepted this tax year. Seconded by Stevens. Roll call: All ayes, no nays, Sinicropi absent. Carried. A motion was made by Sovis, seconded by Dutton that the township charge only the non-sufficient fund fees that we are assessed by the bank. Roll call: All ayes, no nays, Sinicropi absent. Carried. A motion was made by Stevens, seconded by Simpson that the treasurer accept the first payment in as payment. All others will be returned to sender. Roll call: All ayes, no nays, Sinicropi absent. Carried. A motion was made by Dutton, seconded by Sovis that paid receipts no longer be mailed to taxpayers. If the taxpayer requests a paid receipt, it will be necessary for them to include a self-addressed, stamped envelope for said receipt. Roll call: All ayes, no nays, Sinicropi absent. Carried. Jim Capitan reported that there will be a hazardous waste pick-up behind VG’s on August 21, 2004 from 8am-2pm. Sexton Howard Magee spoke of rules he would like to see changed for the cemetery. He will make a list of recommendations to be brought to a future meeting. The Ovid Publice library is waiting for their new electronic system that will help keep accurate records of the books.
