Thursday September 9, 2004 at 7:00 p.m. the regular Middlebury township board meeting held at the Ovid Municipal Building was called to order with the pledge to the flag by supervisor Anthony Sinicropi. Prayer was said by clerk Audrey Sovis. Also present were treasurer Carolyn Stevens and trustee Charles Simpson. Trustee Paul Dutton was absent. There were 18 visitors present. Trustee Paul Dutton entered at 7:03. Mr. James Batterbee of Simpson road expressed strong opposition to the paving of his road because he will lose 8-9 large trees from his front yard. Other Simpson road residents were in attendance with the majority, by show of hands, in favor of having the paving project completed. Any resident with concerns about this project was urged to write a letter to Sinicropi and he will forward them to the county road commission. Mrs. Gary Holzhausen spoke on behalf of her husband who is running on the republican ticket for County Drain Commissioner. Jim Capitan reported that the county budget is tight but in good shape. He was pleased to say that there have been no layoffs. He also spoke of his running for re-election as County Commissioner on the republican ticket. Bill Lasher, Ovid Village president, requested a board member to represent Middlebury at a recycling meeting beween the township, village of Ovid and township of Ovid to discuss a contract with the recycling company and the needs of the community. He also asked for board action on the sewer ordinance brought before the board in July. Sinicropi reported on progress of Kevin Hehrer’s Eagle Scout project at the Middlebury Cemetery. He will have a work date on September 18 and would appreciate any help offered to install a new fence and sign. Bill Kline inquired on the Metz trailer situation. Sinicropi will contact David Chrenka to check on the status of the clean-up of that property. A request was made by Sovis to attend an elections workshop in Flint October 7, for $75.00. Sovis reported that the annual audit conducted by Demis & Wenzlick was finished. The final report was complete with no recommendations to the board. A motion was made by Dutton seconded by Simpson to accept the auditor’s comments of the 2004 annual audit. Roll call: Sinicropi aye, Dutton aye, Simpson aye, Stevens aye, Sovis aye. No nays, carried. A motion was made by Simpson, seconded by Dutton to approve the agenda. All ayes, no nays, carried. A motion was made by Dutton, seconded by Simpson to accept the minutes of July 8, 2004 with noted corrections. All ayes, no nays, carried. A motion was made by Sinicropi seconded by Sovis to accept the minutes of the July 31, 2004 special meeting. All ayes, no nays, carried. A motion was made by Sovis, seconded by Sinicropi to accept the treasurer’s report. Roll call: Sinicropi aye, Stevens aye, Dutton aye, Simpson aye, Sovis aye. No nays, carried. A motion was made by Simpson seconded by Dutton to accept payment of the August bills in the amount of $8, 624.87 (cks# 1244-1273). All ayes, no nays. Carried. A motion was made by Simpson, seconded by Sovis to accept the payment of the September bills in the amount of $11,585.10 (cks# 1274-1300). All ayes, no nays, carried. A motion was made by Stevens, seconded by Sinicropi to approve the millage request as presented by assessor Stephen Schweikert with .9436 for operating and 2.2187 for fire and ambulance. Roll call vote: Sinicropi aye, Sovis aye, Stevens aye, Dutton aye, Simpson aye. No nays, carried. Violation notices were read concerning properties owned by Mr. Roger L. Jones and Irwin and Mary Oviatt. A motion was made by Sovis, seconded by Stevens to retain Gary Fortin as Middlebury township’s permanent sexton. Roll call: Simpson aye, Dutton aye, Stevens aye, Sinicropi aye, Sovis aye, no nays, carried. Mr. Fortin reported that Gale Mead has requested that shrubs be removed from their family’s headstone at the cemetery. He also reported the need for some top soil and discussed the possibility of renting a backhoe or hiring one to remove various shrubs that have gotten too large. Resolution 2004-2 A motion was made by Sinicropi, seconded by Stevens to accept the sewer ordinance 04-1 with noted spelling correction made to Shiawassee in the ordinance summary above the first paragraph. Roll call vote: Sinicropi aye, Simpson aye, Dutton aye, Stevens aye, Sovis aye. No nays. Carried. Dutton reported that the Public library rule that board members not be paid was rescinded. A motion was made by Sinicropi, seconded by Sovis to pay Middlebury library board member $15.00 per meeting. Roll call vote: Sinicropi aye, Simpson aye, Dutton aye, Stevens aye, Sovis aye, no nays, carried. The election commission will meet at the town hall on Monday October 4, 2004 at 7:00 p.m. to appoint election inspectors for the 2004 General Election Sinicropi reported that the Ovid-Middlebury Emergency Services is thinking of expanding. The Emergency Services board is looking into several options including adding on or building a new building. Stevens suggested that if they build, they consider including township offices for Middlebury and possibly a community center for receptions and large gatherings. At 9:47 p.m. a motion was made by Sovis, seconded by Simpson to adjourn. All ayes, carried. October 4, 2004 at the Middlebury township hall, the Elections Commission met to appoint election inspectors for the November 2, 2004 General election. Present at the meeting were supervisor Anthony Sinicropi, clerk Audrey Sovis, and treasurer Carolyn Stevens. The meeting was called to order by Sovis at 7:00 p.m. A motion was made by Stevens, seconded by Sinicropi to appoint Cindy Dennison (R), Kathy Taylor (R), Lois Wadsworth (R), Marsha Unterbrink (D), Elizabeth Billings (D), Kathy Groom (D), and Raynaldo Rodriquez (D).
