Thursday November 11, 2004 at 7:00 the regular Middlebury township board meeting held at the Ovid Municipal Building was called to order with the pledge to the flag by supervisor Anthony Sinicropi. Prayer was said by clerk Audrey Sovis. Also present were treasurer Carolyn Stevens and trustees Paul Dutton and Charles Simpson. There were 7 visitors. Justin Horvath of the Chamber of Commerce gave a quarterly report on the Shiawassee Economic Development Program. He reported on a new business coming to Perry after a recent land purchase was made there. Geri Terry from Demis & Wenzlick Accounting Services gave an explanation of GASB 34, a change of process in financial reporting. She informed the board of the pros and cons of complying. After discussion among board members, a motion was made by Sinicropi seconded by Dutton that Demis and Wenzlick be notified that the Middlebury township board is opting to not comply with GASB 34. Roll call vote: Simpson aye, Dutton aye, Sinicropi aye, Stevens aye, Sovis aye, no nays. Carried. Jim Capitan thanked the board for the support shown to him during the election. A motion was made by Dutton, seconded by Simpson to approve the agenda. All ayes, no nays, carried. A motion was made by Sinicropi, seconded by Simpson to approve the minutes of the October 14, 2004 board meeting. All ayes, no nays, carried. A motion was made by Simpson, seconded by Dutton to approve the treasurer’s report and the payment of the November bills (check #’s 1316-1334, $6401.89). All ayes, no nays, carried. Kevin Bodensteiner from MMPA reported that the DEQ and MMPA are working out the details on the proposed ordinance that would restrict wells to be drilled no shallower than 80 feet. This ordinance is being created for those residents within the high impact area where the MMPA plant previously irrigated waste water. One new well was put in by MMPA for the Noble’s, as it had a high maganese level. It was noted that the Grooms’ well is being closely monitored at this time. Bodensteiner informed the board of his resignation from MMPA effective the end of this month. A motion was made by Dutton, seconded by Simpson to authorize Sinicropi to sign a Homeless Proclamation sent to us by the county. All ayes, no nays, carried. A motion was made by Simpson, seconded by Dutton that the $261.79 given to the township as a memorial to Harold Hehrer, be used to purchase a flag, light and plaque for the cemetery. All ayes, no nays, carried. The Middlebury cemetery deed, for new property purchased, is still in the process of being signed by previous owners of land. Sinicropi reported that Attorney Cooley is handling this issue. There was discussion on the annexation with the village of Ovid requested by Avery Squires. A motion was made by Dutton, seconded by Simpson to authorize Sinicropi to initiate the creation of an inter-governmental agreement by attorney Cooley which will give permission for Mr. Squires or any other resident (other than the school), to hook-up to the water and sewer lines. Roll call vote: Simpson aye, Dutton aye, Stevens aye, Sovis aye, Sinicropi aye, no nays, carried. No decision was made on the annexation request. A motion was made by Sovis, seconded by Sinicropi to appoint Dennis Smalec to the Planning Commission. All ayes, no nays, carried. A motion was made by Dutton, seconded by Simpson to sign the proposed curb and gutter standard resolution sent from the county. Roll call: Sinicropi aye, Simpson aye, Dutton aye, Stevens aye, Sovis aye, no nays, carried. A motion was made by Sinicropi, seconded by Simpson giving approval for Stevens to collect taxes on Monday December 27 and February 14 as well as December 9 and February 10 before the regular board meeting. All ayes, no nays, carried. The oath of office was given to Sovis by Sinicropi. Sovis then gave the oaths of office to Sinicropi, Stevens, Dutton and Simpson. A motion was made by Simpson, seconded by Stevens to let Sovis attend the new officers training seminar in December at a cost of $80.00. All ayes, no nays, carried. Sinicropi reported that there will be another OMESA meeting November 17, 2004 for the Emergency Board only. He asked the board for their opinion on the 3 options that are being considered. As a whole, the board prefers option C, to rebuild in a new location. The primary reason for this being that, the Village of Ovid owns the current structure and Middlebury would never be able to recover any money invested in this building if it should be abandoned in the future. No motions were made. A motion was made by Sinicropi seconded by Simpson to give sexton, Gary Fortin the authority to move the Donald Babcock headstone approximately 34” to the north to comply with the man’s wishes, with the board reimbursing the sexton $50 for his labor. All ayes, no nays, carried. Sinicropi made a motion that the board put $500 towards the Ovid recycling contract for one year to help cover the expense of Middlebury township residents that use this service. Seconded by Sovis. All ayes, no nays, carried. Dutton reported that the library is getting back to normal after a broken water pipe flooded the building. Insurance will cover the cost of the damage. A motion to adjourn was made by Sovis, seconded by Stevens. All ayes, no nays, carried.
