2006-04 Regular Board Minutes
Monday April 10, 2006 the Election Commission met at 5:00 p.m. at Supervisor
Anthony Sinicropi’s home at 8993 Simpson Rd Ovid, MI. Sinicropi, Clerk Audrey Sovis
and Treasurer Carolyn Stevens were present. The meeting was called to order by Sovis.
A motion was made by Stevens, seconded by Sinicropi to appoint the following people as
election inspectors at the May 2, 2006 election:
Audrey Sovis (R) Chairperson
Marsha Unterbrink (D)
Lois Wadsworth (R)
Erin Dutton (D) alternate
All ayes, no nays, carried. The meeting adjourned at 5:10 p.m.

Thursday April 13, 2006 at 7:00 p.m. the regular meeting of the Middlebury
Township board met at the Ovid Municipal Building. The meeting was called to order by
Supervisor Anthony Sinicropi with the pledge to the flag. Prayer was given by Clerk
Audrey Sovis. Board members also present, were Treasurer Carolyn Stevens and Trustee
Paul Dutton. Trustee Charles Simpson was absent. There were 9 visitors.
Scheduled Comments: Deputy Steve Loomis was present, but had nothing to
report.
Public Comments: Mr. Potts from one of the gravel pits came and requested to
meet with Planning Chair Dennis Smalec as the pit’s permit is up for renewal and
township approval is necessary. Michael Leif stated to the board that he felt he was
being taxed unfairly in regard to his property taxes. He stated he felt that assessor Steve
Schweikert was not doing his job properly. Mr. Helvie came with the intent of signing
off on the deed for the cemetery. Attorney Cooley was not at the meeting. Sovis
reported that she had spoken with Cooley the day before and he had said the surveys were
completed but the deeds were not ready. He asked that the board give Sinicropi authority
to sign the deed when it is complete.
General Business: A motion was made by Dutton, seconded by Stevens to
approve the agenda as presented; all ayes, no nays, carried. A motion was made by
Dutton, seconded by Stevens to approve the minutes of the March 9, 2006 board
meeting; all ayes, no nays, carried. A motion was made by Sinicropi, seconded by Sovis
to accept the Treasurer’s report; all ayes, no nays, carried. A motion was made by
Dutton, seconded by Stevens to pay the April Bills in the amount of $13,587.45 (ck #’s
1647-1663) in addition to check #1664 for a $10,000 Improvement CD; all ayes, no nays,
carried.
Communications: A motion was made by Sovis, seconded by Dutton that a
resolution be signed stating this board is in favor of retaining local control of Cable
Franchising; Roll call vote: Dutton aye, Sinicropi aye, Sovis aye, Stevens aye, Simpson
absent, carried. Resolution was signed by Clerk. Sinicropi related to the public present
that 5 board members (one deputy) will be attending the upcoming Capitol Conference in
Lansing at the end of this month. A motion was made by Sinicropi, seconded by Dutton
to accept the Planning Commission’s recommendation to approve the change on the
Conditional Zoning Ordinance from the County; all ayes, no nays, carried.
Unfinished Business: A motion was made by Sovis, seconded by Stevens to
authorize Sinicropi to sign the deed to the cemetery when it is completed; all ayes, no
nays, carried. Sinicropi read the contracts for the 2006 road projects as follows:
1. Gravel on North Avenue from Mabitt St. to dead end. $345.00 Motion to
accept was made by Dutton, seconded by Sovis; all ayes, no nays, carried.
2. Gravel on Vincent Road from Mason to Cronk Road. $16,512.00 Motion to
accept was made by Sinicropi, seconded by Dutton; all ayes, no nays, carried.
3. Gravel on Baldwin from Mason to Cronk Road. Cost share with Owosso Twp.
Our share: $6,720.00. Motion to accept was made by Dutton, seconded by Sovis; all
ayes, no nays, carried.
4. Asphalt Clinton St from the Village of Ovid to dead end. $19,500.00 less
$1,025.00 available gas tax contribution. Our cost: $18,475.00. A motion to accept was
made by Sinicropi, seconded by Sovis; all ayes, no nays, carried.
5. Asphalt Krouse Rd from Warren to Leland Rd. $43,975.00 less available gas
tax contribution of $43,975. Our cost: $00.00. Motion to accept made by Dutton,
seconded by Stevens; all ayes, no nays, carried.
6. Two wide continuous applications of mineral well brine. 26.96 miles x 2000
gallons per mile = 54,500 gallons at a total cost of $9,537.50. Motion to accept made by
Sovis, seconded by Sinicropi, carried.
New Business: Sinicropi reported that he has requested a report from the Ovid
Parks and Recreation Board before the board agrees to give any support. A motion to re-
appoint Sovis as the 2006-07 FOIA Coordinator was made by Stevens, seconded by
Dutton; all ayes, no nays, carried. A motion was made by Sovis, seconded by Dutton to
pay the Planning Chair $25 plus mileage whenever he attends a county meeting as a
representative of Middlebury Township; all ayes, no nays, carried. A motion was made
by Sovis, seconded by Sinicropi to approve the election inspectors for the May 2, 2006
election; all ayes, no nays, carried. The inspectors will be: Audrey Sovis Chairman,
Marsha Unterbrink and Lois Wadsworth. Erin Dutton approved as an alternate.
Discussion was took place on the possibility of obtaining the property on the east and
north side of the township hall as the building is currently land-locked and accessible
only by an easement. A motion was made by Stevens, seconded by Sinicropi to have
Deputy Supervisor Givens and Clerk Sovis draw up a letter of intent to send to Richard
Johnson the property owner, requesting the opportunity to purchase these strips of land;
all ayes, no nays, carried. The board requested to see the letter before it is sent.
Reports: Sexton Gary Fortin reported that he is in need of a new hedge trimmer
as he is currently borrowing one now. A motion was made by Sinicropi, seconded by
Stevens that he be permitted to spend no more than $300 on a new hedge trimmer; all
ayes, no nays, carried. Sinicropi reported that the township of Ovid has approved the
spending of $70,000 for a road off Austin road to have access to the new Emergency
Services Building. He also reported that the Village of Ovid has stated that it will not
provide water and sewer to the site without annexation.
At 8:57 p.m. a motion was made by Stevens, seconded by Sinicropi to adjourn; all
ayes, no nays, carried.
