Thursday May 11, 2006 at 7:00 p.m., the regular meeting of the Middlebury Township board met at the Ovid Municipal building at 114 East Front St. Ovid, Michigan. The meeting was called to order by Supervisor Anthony Sinicropi with the pledge to the flag. Prayer was given by Clerk Audrey Sovis. Board members also present were: Treasurer Carolyn Stevens, and Trustees Charles Simpson and Paul Dutton. There were 9 visitors. Scheduled Comments: Drain Commissioners Gary Holzhausen of Shiawassee County and Phil Hanses of Clinton County came and presented the board with an Inter- County Drain resolution to sign. Hanses estimated that the cost to repair a culvert in the Village of Ovid and clean the drain which extends into Middlebury Township should not exceed $22,600. Resolution 2006-3 A motion was made by Sinicropi, seconded by Dutton to authorize the Inter-County Drain Authority to levy a special assessment, as allowed by law, on those land owners that are directly affected by the drain, over a time period of 2 years. Roll call vote: Stevens aye, Sovis aye, Sinicropi aye, Simpson aye, Dutton aye, no nays, carried. Both the Village of Ovid and Middlebury Township will be billed first. Public Comments: Resident Larry Jones asked the board to sign a resolution on a land split that would allow partial termination of PA-116 (land that has at least one structure located on the parcel prior to the agreement). After discussion with the Township Attorney, Mark Cooley, the board found the request acceptable. Resolution 2006-4 A motion was made by Sovis, seconded by Sinicropi to authorize the signing of the resolution. Roll call vote: Simpson aye, Sinicropi aye, Stevens aye, Sovis aye, Dutton aye, no nays, carried. The actual signing did not take place at the meeting, but was scheduled for the next day to accommodate the need for a notary. Leighton Leighty entered at 7:10 p.m. General Business: A motion was made by Simpson, seconded by Dutton to approve the agenda as presented; all ayes, no nays, carried. A motion was made by Dutton, seconded by Simpson to approve the minutes of the April 13, 2006 board meeting; all ayes, no nays, carried. A motion was made by Dutton, seconded by Sovis to approve the Treasurer’s report; all ayes, no nays, carried. A motion was made by Dutton, seconded by Stevens to pay the May bills in the amount of $1,767, 36 (ck #’s 1665- 1675); all aye, no nays, carried by signature vote. Communications: A letter was read from the Department of Agriculture concerning Green Meadows Farms. A complaint was received regarding manure management and excessive odors. An inspection found the farm to be in compliance with the law. Unfinished Business: Attorney Mark Cooley reported that the deeds to the cemetery were ready for signing, but he has not had them recorded. He brought a bill for $900 for the survey to the board’s attention, saying that he thought that was too much. The board agreed and he will dispute the matter with Land Mark Surveying. New Business: A motion was made by Simpson, seconded by Dutton to contract $1,500 again this year with the Mid-Michigan Area Group Narcotics Enforcement Team (MAGNET). According to a letter sent by Gretchen Voltz, Unit Commander of MAGNET, there were 163 investigations in Shiawassee County in 2005; Middlebury had 9 of those, making up approximately 5% of the County’s investigations. A motion was made by Sinicropi, seconded by Dutton to support the Parks and Recreation with $500; roll call vote: Dutton aye, Simpson aye, Stevens aye, Sovis aye, Sinicropi aye, no nays, carried. Sovis made a request for an enclosed, cork, posting board for the township hall, as the need to post announcements and other items has increased with the consolidation of elections. The current board is open to the elements and posted items often disappear or are destroyed. It was recommended that the clerk contact Everett Smith at the High School to see if students could make a board. Dutton will check with a company that makes them, as well. The need for approval of ballot language regarding the OMES millage renewal was discussed. Dutton reported that MTA advised that the board not approve the ballot language as presented at this meeting. A motion was made by Dutton, seconded by Simpson, that the board hold a special meeting Tuesday May 16, 2006 at 7:00 p.m. at the township hall to approve new ballot language provided by MTA legal counsel; all ayes, no nays, carried. Reports: Sinicropi reported that Ovid Township has put in a service road off Hollister road to accommodate future businesses, at a cost of $10,000, not $70,000 as was reported in the April minutes. At 9:03 p.m., a motion was made by Stevens, seconded by Sovis to adjourn; all ayes, no nays, carried. Sinicropi called a special meeting for May 25, 2006 at 5:00 p.m. at the Middlebury Township Hall to adopt the language for the Emergency Services Proposal for the August Primary Ballot.
