Thursday November 9, 2006 at 7:00 p.m., the regular meeting of the Middlebury
Township Board met at the Ovid Municipal Building, at 114 East Front Street Ovid, MI.
The meeting was called to order by Supervisor Anthony Sinicropi with the pledge to the
flag. Prayer was given by Trustee Charles Simpson. Board members also present were
Clerk Audrey Sovis, Treasurer Carolyn Stevens and Trustee Paul Dutton. There were 5
visitors.
Scheduled Comments: Deputy Steve Loomis of the Shiawassee County Sheriff’s
Department brought the Middlebury Township 911 events for the month of October. He
commented on the trash being dumped on Austin road.
Public Comments: None
General Business: A motion was made by Dutton, seconded by Simpson to
approve the agenda as presented; all ayes, no nays, carried. A motion was made by
Dutton, seconded by Simpson to approve the minutes of the October 12, 2006 election
commission and board meeting with the correction of the ending time of the election
commission being 6:45 p.m., not 7:45 p.m.; all ayes, no nays, carried. A motion was
made by Sinicropi and seconded by Sovis to accept the Treasurer’s report as presented;
all ayes, no nays, carried. A motion was made by Dutton and seconded by Sinicropi to
pay the November bills in the amount of $5,337.19 (checks 1781-1798); all ayes, no
nays, carried by signature vote.
Communications: Planning Chairman, Dennis Smalec reported to the board that
the PC recommends the acceptance of the proposed text amendment on “Adaptive Use”
that was sent from the County. The purpose of this amendment is to foster the renovation
and reuse of structures that have historic, architectural, or economic value to the County
and are vacant or at risk of becoming under utilized, vacant or demolished. There are
numerous criteria and performance standards that must be met for eligibility. Any
property in any zone is eligible for adaptive reuse status if it meets the requirements.
Submission and review of a project qualified for adaptive reuse shall be in accordance
with the procedures set forth in Article 12, Special Use Permits. A motion was made by
Sovis and seconded by Dutton to send a letter of recommendation to the County that the
proposed text amendment be accepted as presented; all ayes, no nays, carried.
Unfinished Business: Board of Review and Ovid-Middlebury Emergency
Services Board members have been contacted by Sinicropi and all will accept re-
appointment of their position, but one, whose decision is still unknown. Appointments
will take place at the regular December meeting.
New Business: Sovis discussed the desire to create a “policy book” for the
township so that policies could be found in one place and the next clerk would be able to
locate answers quickly and efficiently. A request was then made that the board decide if
Deputies will have their dinner paid for when attending the local Shiawassee MTA dinner
meeting each year, which is currently at a cost of $10 a person. Resolution 2006-16:
Discussion took place and Stevens made the motion that the township pay for all
Deputies and Planning Commission Board members who desire to go to the Annual
Shiawassee Chapter MTA dinner meeting. Sinicropi seconded the motion. A roll call
vote was taken: Simpson aye, Stevens aye, Sinicropi aye, Sovis aye, Dutton aye, no
nays, none absent, carried.
Discussion took place regarding whether or not the board would pay for Deputies
to attend the Annual Conference in January each year. Resolution 2006-17: A motion
was made by Dutton, seconded by Sovis that those board members or Deputies who
desire to attend the MTA Annual Conference shall have registration and hotel paid for by
the township. A roll call vote was taken: Simpson aye, Stevens aye, Sinicropi aye, Sovis
aye, Dutton aye, no nays, none absent, carried.
Discussion took place regarding the listing of a board members’ position followed
by their name when signing a letter that will be published. Resolution 2006-18: A
motion was made by Sovis, seconded by Stevens that any communication drafted by a
board member who signs their name and board position at the bottom, must first get
approval from the entire board before they may have it published. A roll call vote was
taken: Stevens aye, Sovis aye, Sinicropi aye, Dutton aye, Simpson aye, no nays, none
absent, carried.
Discussion took place regarding the board paying for meetings that the library
president, who is also a Middlebury Township resident, attends out of town. It was
questioned as to who paid for the past presidents’ meetings when that person was from
Ovid Township. A motion was made by Simpson, seconded by Dutton to table this
matter until more information is known; all ayes, no nays, carried.
Reports: County Commissioner James Capitan discussed the County budget that
will be up for approval next month. He stated that the budget was set at $19,357,000.00.
This is $400,000 more dollars that last year. There is still a wage freeze on and
employees can be replaced, but there will be no new positions created. The county is
operating on a 5.1146 millage rate which is down from 5.555 10 years ago due to the
Headly Amendment. He stated that there is not much new on the Rails to Trails project
as the state will now take over the title search job. Part of the money from the Meijer
Foundation will help to maintain the Trail in the future.
Dutton reported that the drainage problem at the library has been solved.
Sovis asked that the board give approval to write a check for those who will be
attending the Shiawassee Chapter MTA dinner meeting this month. A motion was made
by Dutton, seconded by Stevens to write a check for the exact number of approved
attendees going to the MTA dinner meeting; all ayes, no nays, carried.
A motion was made by Simpson, seconded by Stevens to adjourn at 8:15 p.m.; all
ayes, no nays, carried.
