Front St. (Ovid Municipal Building). The meeting was called to order at 6:30 P.M. by Supervisor Anthony Sinicropi with a Pledge to the Flag and Trustee Paul Dutton then led the group in a prayer. Roll call was taken with the following board members present: Supervisor Anthony Sinicropi, Clerk Susan Tomasek-Swan, Treasurer Carolyn Stevens, and Trustees Paul Dutton and Erin Dutton. Also present were 23 guests among which were Deputy Steve Loomis, Village of Ovid President Bill Lasher, County Commissioner Dan Stewart, Deputy Clerk Shawn Dilts, and Planning Commission Chairman Doug Krebiehl Public Comments: None Presentation of the Budget: Trustee Erin Dutton asked about a new line item for the internet service. It was explained that line item 101-228 Technology was created to track the expense. Treasurer Carolyn Stevens discussed the amount of money being budgeted for the Roads line item and wanted to know if some of the projects for this year could wait so that more money could be set aside for the Hibbard Road maintenance after the bridge on that road was repaired. Trustee Paul Dutton explained that in addition to the road millage most townships will budget an amount equal to their 10 year average contribution to road maintenance. Dutton continued by pointing out the other major road to be maintained will be Baldwin Rd. which is shared by Owosso Charter Township. Treasure Carolyn Stevens and Clerk Susan Tomasek-Swan expressed that the Road Commission may be adding all the additional projects due to the fact that Middlebury has a road millage and not because there is a need for the roads to be maintained this year. Supervisor Anthony Sinicropi felt it was better to maintain the minor road projects this year and then when Hibbard road is up for maintenance, it will be the only road project for the township. Trustee Paul Dutton discussed the increase in the amount budgeted for the hall. He stated that maybe a well and other projects could be done to update the hall. Bill Kline from the Board of Review mentioned that he looked at the electrical in the hall and it was not up to code. Trustee Paul Dutton also spoke on the figure for the cemetery line item in regards to Maple Grove Cemetery. He was unsure what funds may be needed; If there is an increase in storms which could bring down trees, limbs and damage to the area. www.middleburytownship.org Supervisor Anthony Sinicropi changed the amount for the CD for fiscal year 1009-1010 from $17,000.00 to $12,000.00 and also changed line item Roads (451) from $125,000.00 to $130,000.00. A motion was made by Trustee Erin Dutton to adjourn the budget portion of the meeting at 7:10 P.M. and to reconvene at 7:15 P.M. for the regular meeting. At 7:15 P.M., a motion was made by Clerk Tomasek-Swan to reconvene the meeting for the regular portion. The motion was seconded by Trustee P. Dutton. A roll call vote was as follows: E. Dutton-yes; P. Dutton-yes; Stevens-yes; Tomasek-Swan-yes; Sinicropi-yes. The motion was carried. At 7:15 P.M., Supervisor Anthony Sinicropi called the regular meeting to order. Scheduled Comments: Steve Loomis stated everything at the sheriff department is running smoothly. The department has been freshly painted and the upgrades to the courthouse for the metal detection are not quite complete. Trustee Paul Dutton asked Deputy Loomis, who washes the cruisers. He stated the trustees wash them and that the new cruisers will be black in color. Bill Lasher, Village of Ovid President, spoke on the new wireless internet service being brought to our area by Mutual Data. The Village is working on an agreement to lease out their water tower to them. The company Invisalink has not returned any of the Villages phone calls. The area covered by Mutual Data will encompass most of Middlebury Township. He stated that residents will need to purchase an antenna to receive the signal. Mutual Data can be reached at 989-224-6839. Dan Stewart reviewed new board appointments. He congratulated Supervisor Sinicropi on his award. He spoke on possible stimulus money uses; Food service fees for non-profits being waived and rails to trails activities. Public Comment: Gene Ruess announced that a public board was being put together to discuss the fire building issue. The meeting will be on March 18, 2009 at 7 P.M. in the Ovid Municipal Building. Bill Kline commented that if anyone wants to have certain improvements to be considered for the township hall, it should be submitted in writing to the board members. Bill continued to speak on the township hall’s physical condition. He noted that the ceiling was void of any insulation. Trustee Paul Dutton voiced an opinion of placing a self-draining well to avoid broken pipes in the winter. Lynn Givens asked if the well will need to be dug deeper. Supervisor Anthony Sinicropi added that water was a necessary improvement. General Business: A motion was made by Supervisor Sinicropi and seconded by Trustee E. Dutton to accept the agenda with the following additions: item (g) handicap accessibility under Communications and item (j) Bruce Seidel’s land split under New Business. A motion was made by Supervisor Sinicropi and seconded by Trustee E. Dutton to approve the February minutes with the following corrections: page1 paragraph 6, omit the ‘s on Road; page 3,paragraph 7 add vote for P. Dutton; page3 paragraph10 and 11 strike offer add offered; page4, paragraph 4 add roll call vote; page 4 paragraph 7 strike the word stated and add the word spoke. A roll call vote was as follows: P. Clerk Tomasek-Swan made a motion to amend the budget from the account (901) appropriate to other funds to the accounts of emergency service (336) for $500.00 and street lights (450) for $200.00. The motion was seconded by Treasurer Stevens. A roll call vote was as follows: P. Dutton-yes; E. Dutton-yes; Stevens-yes; Tomasek-Swan-yes; Sinicropi-yes. The motion was carried. A motion was made by Trustee P. Dutton and seconded by Trustee E. Dutton to pay the bills with checks 2320 thru 2346 in the total amount of $16,535.77 with a void on check # 2326. Communications: Clerk Tomasek-Swan asked if any of the board members wanted to sign-up for a free email newsletter from Fahey, Schultz, Burzych, Rhodes. Supervisor Sinicropi read the letter from Charter Communications about the bankruptcy being filed by their company. The annual SEDP report was presented for the board to review. The OMESA fire report was presented for review by the board. Trustee Paul Dutton, Supervisor Sinicropi, and Clerk Tomasek-Swan spoke on the MTA class of Budgeting that was attended on February 24th. Bill Kline briefly informed the board on how the Board of Review meeting went this week. Bill stated about 12 people came out to discuss minor problems to the present day economic situation. Clerk Tomasek-Swan received a letter from the State of Michigan regarding the handicapped accessibility of the hall. She will follow up on the letter to find out if the hall meets the current codes. Unfinished Business: A motion was made by Clerk Tomasek-Swan and seconded by Trustee Erin Dutton to indefinitely table the Intergovernmental Agreement with Ovid Township until further notice. Resolution 2009-05, Adoption of the Budget for Fiscal year 2009-2010, was offered by Trustee Erin Dutton and seconded by Trustee Paul Dutton. A roll call vote was as follows: P. Dutton-yes; E. Dutton-yes; Stevens-yes; Tomasek-Swan-yes; Sinicropi-yes. The Supervisor declared the resolution adopted. New Business: Clerk Tomasek-Swan reviewed information that she received from MTA regarding calling special meetings. Trustee Erin Dutton made a motion to appropriate $500.00 to the MAGNET program. The motion was seconded by Supervisor Sinicropi. A roll call vote was as follows: P. Dutton-yes; E. Dutton-yes; Stevens- yes; Tomasek-Swan-yes; Sinicropi-yes. The board discussed if it would be possible for the township to participate in the program. A motion was made by Trustee Erin Dutton and seconded by Clerk Tomasek-Swan to send Doug Krebiehl and Bob Dennison to the Wind Energy meeting on April 1, 2009 at a cost of $55.00 each. Trustee Erin Dutton made a motion to reappoint Heather Kline to the library board as Middlebury representative. The motion was seconded by Trustee Paul Dutton. A roll call vote was as follows: P. Supervisor Sinicropi read resignation letters from Charles Simpson and Paul Dutton as representatives on the OMESA board. Trustee Paul Dutton made a motion to appoint Richard Semans as Middlebury Township member at large representative for the OMESA board. Supervisor Anthony Sinicropi seconded the motion. A roll call vote was as follows: P. Dutton-yes; E. Dutton-yes; Stevens-yes; Tomasek-Swan-yes; Sinicropi-yes. The motion was carried. Trustee Erin Dutton made a motion to appoint Carolyn Stevens as Middlebury Township board member representative for the OMESA board. Supervisor Sinicropi seconded the motion. Doug Krebiehl informed the board of a land split request made by Bruce Seidel. Final Comments: None Trustee Erin Dutton made a motion to adjourn the meeting.
