Minutes
Supervisor Anthony Sinicropi called the meeting to order at 7:00 p.m.
Call To Order
with a Pledge to the Flag and a prayer led by Trustee Paul Dutton.
Members Present: Supervisor Anthony Sinicropi, Clerk Susan

Tomasek-Swan, Treasurer Carolyn Stevens, Trustee Erin Dutton
and Trustee Paul Dutton.
Guest Present:
14 guests were present; including Township's attorney, Lynn Bowne.

General Business
Moved by E. Dutton, seconded by Tomasek-Swan to approve the
Motion to Approve Agenda
Agenda with the addition item (e) Driscoll footing (f) appointment
of Michael Herendeen as Deputy Supervisor.

Moved by P. Dutton, seconded by E. Dutton to approve the minutes

from December 10, 2009 regular township board meeting with no

corrections.

checks numbered 2511-2527 in amount of $5,844.18.

Lynn Bowne review with the board about the proposed contract with
OMESA. Some items discussed was the payment schedule of tax revenue,
ability to terminate,and liability. Richard Semans, Middlebury Township's
OMESA representative recommended not to sign a contract but to
continued conducting business as usual. Mr. Bowne stated he felt that
times have changed and a contract would protect OMESA and the
Township.
Richard Semans reviewed and discussed the admendments to the OMESA
budget. Some of the factors for the admending is the attorney fees, THA fees,
and two big fires.
E. Dutton made a motion to approve the admendments to the OMESA

original budget as stated in the by-laws. Motion was supported by
P. Dutton.

C. Stevens addressed the issue of Ovid township payment of tax revenue
Emergency Service Escrow
to OMESA. In an event of dissolution of OMESA, Ovid township could take
Two-thirds of the revenue which would be part of Middlebury's emergency
service tax dollars unless both townships are on the same payment schedule.
C. Stevens made amotion to put emergency tax dollars into an escrow
accountant and begin monthly payments to OMESA. The motion was
supported by E. Dutton.

Tomasek-Swan made a motion for approval of check for MTA
BOR MTA meeting
Board of Review meeting. Motion seconded by P. Dutton.

NO: none CARRIED
P. Dutton made a motion for a no liability contract with Robert and Joanne
Marble foundation
Driscoll in regards to the marble foundation for the bench headstone being
placed in the cemetery. Sinicropi seconded the motion.

NO: none CARRIED
Richard Semans verbally resigned as Deputy Supervisor. Sinicropi
Richard Semans resignation
regretfully accepted the resignation.
Sincropi made a motion to accept the resignation of Richard Semans as
Deputy Supervisor. Stevens seconded the motion.
AYE: All
NO: none CARRIED
Supervisor Sinicropi appoints Mike Herendeen as Deputy Supervisor.
C. Stevens made a motion to have Mike Herendeen represent the supervisor
as a representative on OMESA committees, working on OMESA contract,
OMESA representative
and By-Laws. Mr. Herendeen would not have any voting powers but would
report back to the board and give recommendation.
Sinicropi seconded the motion.

Supervisor Sinicropi made statements about per capita and the road budget.
The meeting was adjourned at 8:37 p.m. Moved by P. Dutton and
ADJOURNED
