Middlebury Township Board Minutes, October 14,2010 Draft Minutes Approved Middlebury Township Board Regular Meeting 10/14/10 07:00 PM Ovid Municipal Building 114 East Front Street, Ovid, Michigan 48866 Minutes Supervisor Anthony Sinicropi called the meeting to order at 7:00 pm Call To Order with a Pledge to the Flag and a prayer led by Trustee Paul Dutton. Members Present: Supervisor Anthony Sinicropi, Clerk Susan Roll Call Tomasek-Swan, Treasurer Carolyn Stevens, Trustee Erin Dutton and Trustee Paul Dutton. Guest Present: 8 guests present. Richard Semans, Rich Givens, Larry Ordiway, Charlie Moore, Doug Krebiehl, John Tribfelner, Dan Stewart, Mike Herendeen. Scheduled Comments: Scheduled Comments Larry Ordiway and Charlie Moore, representatives from the Maple Grove Cemetery Authority were present to discuss the lease or purchase Closed Session of real estate. Tomasek-Swan made a motion to call a closed session due to the discussion of real estate. E. Dutton seconded the motion. Entered at 7:03pm due to the discussion of real estate. E. Session was opened back to the public at 7:48pm. Dan Stewart, County Commissioner, reviewed the activities at the county level. He briefly discussed the moratorium placed for the next six county level. He briefly discussed the moratorium placed for the next six months on new medical marihuana places of businesses. He talked about a job vacancy at the county level and updated the board on the Rails to Trails project. Public Comments Rich Givens made a comment regarding the painting of the township Opened 8:08pm hall. He liked how the hall was looking. Closed 8:10pm Moved by E. Dutton, seconded by Sinicropi, to approve the agenda Motion to Approve Agenda with the addition of (e) Deputy Supervisor. AYE:All NO: none CARRIED AGENDA APPROVED Moved by Stevens, seconded by P. Dutton to approve the minutes Minutes Approved from September 9, 2010 regular township board meeting with September 9,2010 correction of Paul Dutton leading prayer instead of Richard Semans. AYE: All NO: none CARRIED Moved by Sinicropi, seconded by Tomasek-Swan to approve the Treasurer's Report Approved March Treasurer's report as presented. AYE: All NO: none CARRIED Moved by P. Dutton and seconded by Sinicropi to pay bills with Bills Payment Approved checks numbered 2676-2694 in an amount of $10,757.45 from the General Fund and Checks 1008-1009 in an amount of $11,803.73 from the Road Fund. AYE:All NO: none CARRIED Communications Tomasek-Swan and Deputy Supervisor Herendeen discussed about the Fall District meeting. Unfinished Business The Lupe Garcia matter was discussed with the board's attorney, Lynn Bowne. Mr. Bowne will continue to pursue the matter with another letter to Mr. Garcia's attorney. Richard Semans updated the board on OMESA,in particular the possible FIOA violation. Treasurer Stevens discussed the end of tax season and how the remaining tax dollars in the escrow account arevto be paid. New Business A sign for the township hall was tabled until Spring time. Sinicropi made a motion for the board to pay attendance and hotel monies for three (3) board members to attend the annual MTA conference. Stevens seconded the motion. AYE: All NO: none CARRIED A motion was made by Tomasek-Swan for the board to pay for up to twelve (12) board and committee members to attend the Annual Shiawassee MTA dinner. Members would be responsible to pay for their spouses or guest. Motion was supported by Sinicropi. AYE: All NO: none CARRIED Sinicropi made a motion to approve Clerk, Tomasek-Swan to sign the township for Electronic Fund Transfer for the 941 taxes with the IRS. P. Dutton seconded the motion. AYE: All NO: none CARRIED The board reviewed the role and responsibilities of the Deputy Supervisor.
