Middlebury Township Board Minutes Draft Minutes Middlebury Township Board Regular Meeting Thursday, June 8, 2011 7pm Middlebury Township Hall 7627 W. M-21 Ovid, Michigan 48866 Minutes Supervisor Anthony Sinicropi called the meeting to order at 7:00 pm Call To Order with a Pledge to the Flag and a prayer led by Trustee Paul Dutton. Members Present: Supervisor Anthony Sinicropi, Clerk Susan Roll Call Tomasek-Swan, Treasurer Carolyn Stevens, Trustee Erin Dutton and Trustee Paul Dutton. Guest Present: Six guests attended. The guests were Tony Newman, Drain Commissioner, Mike and Diane Dowler, township assessor, John Tribfelner, township sexton, Michael Herendeen, Deputy Supervisor, and Herbert Beeman. Scheduled Comments: Scheduled Comments Tony Newman, from the drain commission, came to speak about the Patrick Drain on the Nethaway property. While the drain commission was cleaning the drain they found a clog in the tile that passed through the wooded area. Also, Elmer Velmar Green called and stated he was having issues with drains on his property. There is also a 66 acres land parcel in Middlebury township that the drain commission has for sale. In the deed, they must offer the parcel to the original owner first. Mr.. Newman read to the board the state erosion report and passed out information on natural flow of the water. Mr. Herbert Beeman brought to the board's attention an issue with a headstone located in Middlebury Cemetery. The board and Deputy Supervisor, Michael Herendeen, discussed with him that the issue was a family matter and he needs to take it to court to receive any satisfaction. Mr. Beeman was advise to hire an attorney for the matter. Public Comments Opened 7:20 pm Closed 7:27 Moved by P. Dutton to approve the minutes Minutes Approved from May 11, 2011 regular township board meeting with corrections as noted and the addition of who made the first of the computer motion. 05/11/11 AYE: All NO: none CARRIED Moved by Sinicropi and seconded by E. Dutton to approve the Treasurer's report as presented. Treasurer's Report Approved Aye: All NO: none CARRIED Moved by P. Dutton and seconded by Carolyn to pay bills in with Bills Payment Approved checks numbered 2846-2860 and an EFT in the amount of $6,843.33. AYE: All NO: none CARRIED Tomasek-Swan updated the board on the dates for installation and training of BS&A software. Communications Unfinished Business Diane Dowler reported the tribunal decision on the Leaf case. She broke down the cost to Middlebury township . Tom Dwyer, Shiawassee Co. Treasurer, will cut a check of taxes owed to Leaf. Next May will have a charge back to the township. Leaf's current summer bill will be on the new Tribunal decision. New Business Credit card for township. The board weighed the options of having a credit card. Stevens even brought up the idea of having a debit card. Sinicropi made a motion to have the township apply for a debit/credit card for the General Account checking account. Stevens seconded the motion AYE: All NO: none CARRIED The firework's permit for the Owosso Speedway was discussed. Stevens stated the taxes have not been paid. Sinicropi wanted to know if we could get a pre- approval for the fireworks from the board. Stevens felt the taxes should be paid before issuing the permit. 8:15 pm Supervisor Tony Sinicropi left the meeting. E. Dutton made a motion to have P. Dutton to take over the meeting . The motion was seconded by P. Dutton . AYE: All NO: none CARRIED P. Dutton moderated the meeting. John updated the board on the Elm Rd property with the brush hogging. He stated he will do the job as needed to keep the brush in check. He has also found a junk pile buried on the property which needs to be cleaned. The township hall also needs the facade and the trim around the building fixed. There are brushes around the township hall that are in need of trimming. P. Dutton made a motion to approve the brush hogging, the hall maintenance and the purchasing and hanging of blinds for the hall. Stevens seconded. AYE: All NO: none CARRIED Mr. Herendeen updated the board about OMESA. The draft contracts are at the OMESA attorney, Steve Schultz. If everything goes fine, the townships will be able to have their own attorneys review the contracts for the boards' approvals. Supervisor Sinicropi returned at 8:28pm and return moderating the meeting. Jennie Miracle, leasor of the Owosso Speedway arrived at the township meeting. She claimed that her husband had faxed over a request for the fireworks permit. As far as the taxes, Jennie Miracle paid the personal taxes so the fireworks permit can be approved. P. Dutton made a motion for the Clerk to approve the fireworks application pending the paperwork and insurance is in order. E. Dutton seconded. AYE: All NO: none CARRIED E. Dutton made and motion and P. Dutton seconded to approve changing the Clerk's internet service to a wireless card. AYE: All NO: none CARRIED Sinicropi made a motion to reappoint Erin Dutton to the library board Tomasek-Swan seconded. AYE: All NO: none CARRIED The accident fund workman comp insurance. P. Dutton feels we should looked into the MTA company for workman's comp insurance. The board will pursue looking into the MTA insurance and the Accident Fund to compare. A motion for an insurance committee of P. Dutton and Tomasek-Swan to investigate the MTA and Accident Fund. Tomasek Swan made the motion and E. Dutton seconded it. AYE: All NO: none CARRIED Tomasek-Swan made a motion for P. Dutton to attend the July 13th MTU in Saginaw. Stevens seconded the motion. AYE: All NO: none CARRIED Floodplain information was presented at the MTA Shiawassee meeting on Tuesday night. P. Dutton stated we have been given misinformation and that it would not cost the township except for doing the paperwork. Tomasek-Swan stated in may cost the township more in the future. Herendeen stated that it will infringe on property owners that own property in the floodplain area. Herendeen stated that flood insurance can only be bought in a floodplain area.
