Minutes
Supervisor Anthony Sinicropi called the meeting to order at 7:00 pm
Call To Order
with a Pledge to the Flag and a prayer led by Trustee Paul Dutton.
Members Present: Supervisor Anthony Sinicropi, Clerk Susan
Roll Call
Tomasek-Swan, Treasurer Carolyn Stevens, and Trustee Paul Dutton, Absent
Trustee Erin Dutton.
Guest Present: Six guests were present at the meeting. They were Gary Kiger,
Michael Herendeen, Doug Krebiehl, Bob Dennison, Tony Newman, and Diane
Dowler.
Scheduled Comments:
Scheduled Comments
Tony Newman from the Drain Commission presented to the board the drain
resolution for an intercounty drain with Clinton County. Wait Intercounty Drain has
parts going thru the woods and the under the road way. The Clinton County Road
Commission will be taking care the drain portion that runs under the road.
Approximately, $700.00 will be Middlebury Township's responsibility. The Patrick
Drain was cleaned already this year.
Tomasek-Swan offer Resolution 06-2012 for the Wait Intercounty drain with
the support of Sinicropi.

Tony continued to his discussion with showing the new maps that the drain
commission is creating. He also updated the board regarding new lawsuit that is
in the court system that makes the township liable for failing septic systems.
Moved by Stevens, seconded by P. Dutton, to approve the agenda with the
addition of road contracts under new business.

Moved by P. Dutton, seconded by Sinicropi to approve the minutes from the
June 13, 2012.

report as presented.

Bills Payment Approved
Moved by P. Dutton and seconded by Tomasek-Swan to pay bills with
checks numbered 3127-3140 and 1 EFT in an amount of $8,004.75 and
check number 1014 from road fund in amount of 13,732.49.

Communications
Tomasek Swan want to clarify motion with firework motion passed in June's
meeting.
Unfinished Business
Shutters were replaced and repaired by Matt Tribfelner.
New Business
Middlebury Cemetery's fence needs work. Discussion of keeping a fence or
completely removing the fence. The pros and cons were discussed. One pro
addressed was the keeping off road vehicles from travelling in the front.
Sinicropi made a motion to keep a fence on the Middlebury Cemetery with
P. Dutton support.

Headstone issue in cemeteryregarding where it was placed was communicated to
the board.

Sinicropi made a motion to have Clerk Tomasek Swan to investigate the
cost of using the local credit union for the townships banking. P. Dutton
seconded.

Due to no township meeting in August P. Dutton made a motion to approve
paying the August bills. Sinicropi seconded.

Stevens updated the board regarding the Maple Grove Cemetery (MG). The
hospital gave MG everything that they asked for in the land negotiation. MG
board is extremely happy. Stevens reminded the township board about the
money that was given to improve the road way for the property. She stated the
funds should go back to the different entities since the hospital is doing property
improvements for the MG cemetery.
Road Contracts 3 Different contacts 2 Culvert contract and one bituminous
paving.
The Dewey Road contract was tabled until the September meeting Motioned
by Sinicropi and seconded by P. Dutton.

The Warren Road culvert contact is $7,000.00.Stevens made motion P.
Dutton seconded the motion to approve the signing of this contract .

Bituminous Paving Agreement for Warren Road; it is a part of the culvert
contract to black top the area after repair. Tomasek- Swan made the motion
to sign the contract and Dutton seconded the approval.

FINAL COMMENT:
Diane Dowler announced Board of review meeting to fix clerical errors on
Tuesday July 17, 2012.
Doug Krebiehl made a comment calling him for planning commission issues. He
is available after 3 p.m. He addressed the board with his concerns regarding the
wind turbines. Doug is meeting with the county regarding the wind turbines. Bob
Dennison stated the state overrides the county regulations.
Tony Newman stated the turbines companies have already been in the drain
commission office to get the drain maps for Shiawassee county.

The meeting was adjourned at 8:42 pm Moved by Stevens and

seconded by Dutton.
