Call to Order:
Supervisor Herendeen called the meeting to order at 7:02 pm with a pledge to the flag and a prayer led
by Richard Semans.
Board Members Present:
Supervisor Michael Herendeen, Clerk Susan Tomasek-Swan, Treasurer Carolyn Stevens, Trustee Gary
Kiger and Trustee Richard Givens
Guests Present: Six people present: Rose Brown, Mary Nordbeck, Brent Jones, Lynn Givens, Tony
Sinicropi, and Richard Semans.
Scheduled Comments:
Mary Nordbeck-The Sheriff county proposal is the hot topic. She stated the millage needs to pass.
Supervisor Herendeen interjected the needs for the sheriff department.
Mary agreed that this department will take the biggest hit when it comes to cutting the county budget.
In the sheriff department the cut will be the road patrol. The sheriff department cannot cut the jail
because it is the legal responsibility for them to provide. The step increases are still in place but the
raises have not been done since 2002. Every department has lain off people and the buildings need
maintained. Unfortunately they have been taken from the rainy day fund and the delinquent tax fund to
cover the over expenses. Mary again told people there will be no police protection anywhere outside
the city limits.
Brent Jones from SEDP (Shiawassee Economic Development Partnership) updated the board the new
business activities in Shiawassee County. It is getting towards the end of the year and wanted to
encourage Middlebury to continue support for another year.
Clerk Tomasek-Swan Introduced Rose Brown, the new Deputy Clerk, to the Middlebury Township Board.

Motion to Approve Agenda:
Treasurer Stevens made a motion to approve the agenda with the addition of 5. Ceiling 6. MTA Annual
Dinner. Trustee Givens seconded the motion.

Motion to Approve Minutes:
Trustee Givens made a motion to approve the minutes from September 10, 2014 regular board
meeting Clerk Tomasek-Swan seconded the motion.

Motion to Approve Bills:
Trustee Givens made a motion to approve paying the bills with checks 3634-3650 and 2 EFT in an
amount of $ 7,218.22 from General Fund and check 1025 in an amount 4,340.00 from Road Fund
Treasurer Stevens seconded the motion.

Communications:
Park and Recreation- None
OMESA- Dick Semans updated the board with an agreement with the cell tower. The surveyor’s
information has been completed and the board agreed to sign it. The village has given easement to
access the area. OMESA will be struggling with the upcoming budget due the increase of minimum
wage for the ambulance services. It will increase the salary cost to more than $30,000.00 in the budget.
The paperwork for insurances is increasing. Paperwork can take up to half hour before moving the
patient. The Emergency Millage is up in 2023. The millage extension was to get a new building.
Supervisor Herendeen feels ALS (Advance Life Service)would be the way to go because most of the
emergency calls are ALS but he feels the voters need to be able to choose and vote on what they want.
Planning-The meeting in September was the discussion of Zac Potter land rezoning. The planning
committee saw no issues with the rezoning.
Library- None
MTA Meetings- Supervisor Herendeen stated the meeting was mainly about the sheriff millage. The
proposal is being touted as saving road patrol but that is not what the proposal is about. The millage is
for all the use of the county. The county is talking about 14 plus deputies’ positions will be cut to fit the
budget. The Annual Dinner is November 7 starting at 6 pm and Middlebury Township is the host.
Treasurer Stevens and Clerk Tomasek-Swan talked about the legal expenditure class from MTA. The
Cemetery situation with the other two municipalities was brought up and discussed.

Business:
Newsletter- One piece of information to add to newsletter is about the burning permits and
where and how to get one. Any other information needs to be turned into the Clerk. .
Williams Ave Closure-All this began in May 1998, the residents petitioned to have the road
closed. Only one letter was received at the county level and therefore the road was not closed.
So the procedure has to start all over again if the current residents desire to do this. Rich
recommends that the board should write a letter and inform the gentleman that the process
needs to start all over again. Herendeen stated that sending the current letter from the Road
Commission to let them know the current rules. Rich made a motion to send Mr. Todosciuk a
copy of the current rules and regulation of the abandonment of rules and regulation letter
from the county from the Shiawassee Road Commission. Susan seconded the motion.

Zac Potter rezoning issue –Clerk Tomasek-Swan will plan on attending the meeting for the
planning to represent the board and Trustee Givens will be representing the planning
committee.
Ceiling- Trustee Givens stated the roof needs to be replaced and there needs to be a contractor
to check out the roof and the ceiling repair. Find some contractors and get some estimates and
opinions on what needs to be done to improve the hall. Table until information is available
Clerk Tomasek-Swan made a motion to pay for all the regular and planning board members
and deputies who attend the annual Shiawassee MTA dinner. Spouses can attend but they
need to pay for their dinner. Trustee Givens supports.

Clerk Tomasek-Swan brought up a constituent concern about placing a chain across the
driveway to close for a cemetery for the winter season. The concern was about cars becoming
stuck in the snow while trying to get into the cemetery. Most of the discussion was against
closing the cemetery. There was a concern of not plowing the driveway all the time. Therefore
the cemetery should be maintained throughout the winter season.
