Middlebury Township PO Box 622, Ovid, Michigan 48866 Regular Board Meeting Middlebury Township Hall 7627 W M21, Ovid Michigan Wednesday, June 14th, 2017 at 7:00 pm Call to Order: Supervisor Herendeen called the meeting to order at 7:08pm with a pledge to the flag and a prayer led by Trustee Richard Semans. Board Members Present: Supervisor Michael Herendeen, Clerk Rose Brown, Treasurer Carolyn Stevens, Trustee Gary Kiger and Trustee Richard Semans Guests Present: Seven guests were present. Among the guests were Mike and Diane Dowler, Arlene Pesik, Carl Chalker, Karl Heckman, Mike Bruff and Susan Tomasek Swan. Scheduled Comments: Mike Bruff- (County Commissioner) Mr. Bruff updated the board on events occurring in Shiawassee County. One event is the Tire Collection on July 29 8 to 12 or until the trailer is full at the Shiawassee County Road Commission located on 701 West Corunna Ave., Corunna. The cost will be for auto tire $2.00 without rims and $3.00 with rims and semi-truck tires cost will be $5.00 without rim and $10.00 with rims. No tractor tires will be accepted at his event. The second event is Free Wellness Yoga for Senior starting on June 12 Monday and Wednesday at 10:00am and 11:00 am. This class is gentle yoga got anyone 60+ years old. Location of this class is at Corunna Community Center, 421 Emma Drive, Corunna. A donation of $1.00 is suggested but not mandatory. Please bring a towel and a yoga mat. Public Comments: Opened at 7:12 pm Closed at 7:12 pm None Motion to Approve Agenda: Trustee Semans made a motion to approve the agenda as presented. Treasurer Stevens seconded the motion. Yes: All Nay: None Carried Motion to Approve Minutes: Treasurer Stevens made a motion to approve the minutes from May 10th 2017 with corrections of Clerk changed to Trustee and striking of a statement miss recorded. Clerk Brown seconded the motion. Aye: all Nay: None Carried Motion to Pay Bills: Treasurer Stevens made a motion to pay bills in an amount of $7,294.94 with 1 eft and checks numbered 4199-4211. This was supported by Trustee Semans. Yes: All Nay: None Carried Communications: Park and Recreations: Trustee Kiger briefed the board on actions of the park and recreations board. Library: Deputy Clerk Swan briefed the board on the library board. The library is working on updating the phone system in the library and creating personal policy. MTA Meeting: Owosso Township hall was the last meeting for the summer break. It was on people opinions on the wind turbines. No meeting for July or August. OMESA: Supervisor Herendeen briefed the board on the OMESA activity. They are working on a hiring a trainer for future firefighters. Assessor: Diane Dowler, township’s assessor announced the July BOR (Board of Review) meeting on July 18th (Tuesday). The time of meeting has yet to be announced. All data has been given the county and is balanced for our township. Business: 1. Cemetery Landscaping- The fence has been taken down. Deputy Clerk Swan briefed the board on a complaint received from a person. Treasurer Stevens presented the board pictures of a columbine from St. Paul’s Cemetery in Owosso. Treasurer Stevens suggested this would be something nice to do at Middlebury Township’s cemetery. Deputy Clerk Swan suggested signs for sections. Supervisor Herendeen really wants to replace the fence at the cemetery. 2. Clerk Brown called Abraham and Gaffney to get a quote of$ 750.00 to perform F65. Trustee Semans made to the motion to use Abraham and Gaffney Company to perform the F65. Clerk Brown seconded the motion. Aye: All Nay: none carried 3. Adoption of the Governess Principles- Trustee Semans made the motion to accept the Governing Principles Clerk Brown seconded the motion. Aye: All Nay: none carried 4. Par Plan Gary Brandt sent a letter to vote for him in the Par Plan election. No action was taken by the board. 5. Supervisor Herendeen received a call from Corky McCreery and he visited his road. He stated there is a lot of traffic on his (Corky McCreery) road. Supervisor Herendeen is going to call Road Commission regarding adding another layer of brine to Wilkinson Road. The trucks go nonstop and the dust is thick. Final Comments: Opened at pm 7:45 Closed at 8:18pm Trustee Kiger wanted to ask about the ordinance that was placed in the paper. Kiger asked how can we pass a grass ordinance but can’t do anything with the fence. There is a fence in Caledonia Township that has the same height and wants to know why the one in Middlebury needs to be taken down. Supervisor Herendeen reminded everyone the Shiawassee County Planning Commission meets the third Wednesday of the month. Herendeen stated the county fence ordinance states; front yard fencing no higher than 4 feet tall and 75% opened. Typically, the zoning enforcer responds only when someone complains. Carl Chalker stated that his fence is placed for noise nuisance. Carl claims the noise level wasn’t that high when he moved there. Trustee Kiger stated a resident had an issue with the county Zoning Enforcer. Karl Heckman asked for an explanation of the Right to Farm Act. He also asked if Carl Chalker should have the right to know his accuser (complainer). Supervisor Herendeen stated Mr. Chalker does not have the right to know who complained. Mr. Heckman asked why the Middlebury Township does not have our own zoning department. Supervisor Herendeen explained the cost factor of running a zoning board with cost of employees and legal fees involved. Supervisor can sympathized with the fence issue and he can see both sides of the issue. The decision is at the county level.
