Middlebury Township PO Box 622, Ovid, Michigan 48866 Special Board Minutes Middlebury Township Hall 7627 W M21, Ovid Michigan Wednesday, September 12, 2018 at 7:00 pm Call to Order: Supervisor Herendeen called the meeting to order at 7:00 pm with a pledge to the flag and a prayer led by Richard Semans. Board Members Present: Supervisor Michael Herendeen, Clerk Rose Brown (Absent), Treasurer Carolyn Stevens, Trustee Gary Kiger and Trustee Richard Semans Guests Present: Arlene Pesik, Brian Behrens, Doug Behrens, Dane Porter (SK&T auditor), Carl Chalker and Karl Heckman Scheduled Comments: Dane Porter, SK&T audit manager, reviewed the 2017-2018 fiscal year audit. The SK&T auditors gave a clean opinion to the township. He reviewed the township numbers of the past two fiscal years activities. They stated the township has healthy numbers. He reviewed the short term financial. He noted the Emergency fund was a restricted fund meaning the money was earmarked for a specific reason. The numbers ran consistent except for the emergency service. Same for expenditures, an increase due to emergency services. A recommendation was noted that the emergency fund needs to set up its own fund. Danny Miller, candidate for District 1 county commissioner and former Owosso township supervisor, introduce himself and discussed his views. He expressed that he has made his vote based on the issue and what is best. He stated that he is non-political when it comes to making his decisions. He reviewed all his qualifications from his past years of working on a variety of local governmental positions and his life experiences and education. Carl Chalker asked Mr. Miller the question to him regarding socialism and communism. Mr. Miller responded to Mr. Chalker question by saying he studied socialism and he will not be a part of it. Mike Bruff- Absent- There is discussion at the county about switching to BSA software. Public Comments: Opened at 7:21 pm Closed at 7:21pm None Motion to Approve Agenda: Treasurer Stevens made a motion to approve the agenda with the addition of survey expense approval. Trustee Semans seconded the motion. Yes: All Nay: None Carried Motion to Approve Minutes: Trustee Semans made a motion to approve the minutes from the July 11th 2018. Treasurer Stevens seconded the motion. Yes: All Nay: None Carried Motion to approve August and September Bills: Treasurer Stevens made a motion to approve the bills from July 31, 2018 to September 12, 2018 from the General Fund in an amount of $18,011.05 and from the Emergency Fund in an amount of $1,132.50 for a total of $19,143.55 with 11 EFT and checks 4871-4909. Yes: All Nay: None Carried Communications: Park and Recreation: None OMESA: The building is going up! The projected date for completion is end of Fall. Everything is going smoothly for the building. Library: Meetings has been changed to Tuesday nights. MTA Meeting: Started back in September in Caledonian township. Brad Howard from Burns Township is now the chairman. The next meeting is Tuesday, Oct 2nd. Mr. Herendeen is not sure who is hosting. Assessor Communications: Diane Dowler has the L4029 and that is on the agenda for approval. Business: Approve Audit: Trustee Semans made a motion to accept the audit report as presented to the board from SK&T. Treasurer Stevens seconded the motion. Yes: All Nay: None Carried Cemetery Issues: A. Givens lots buy back-Treasurer Stevens made a motion to purchase back two plots from Richard and Lynn Givens in an amount of $300.00. Trustee Semans seconded the motion. Yes: All Nay: None Carried B. Behrens- Lot headstone centered Herendeen made the motion contingent on purchase of grave site 2, the approval of headstone placed in centered of the lots 1 and 2 and 5 and 6. Trustee Semans seconded. Yes: All Nay: None Carried C. Releasing of wild animals in cemetery- It has been brought to the attention that a township resident is trapping wild animals in the back yard and releasing the critters in the woods by the cemetery. No action taken by board. D. Wood cutting in cemetery-Trustee Semans made a motion no cutting or removal of wood from the cemetery unless receiving permission by the township board. Treasurer Stevens seconded the motion. Yes: All Nay: None Carried L-4029 Approval and signing- Supervisor Herendeen made a motion to approve the signing of the L- 4029, tax rate request for 2018. Treasurer Stevens seconded the motion. Ayes: All Nays: None Approved Approve Insurance Renewal- Policy has not been received. This will be tabled until October. Survey-Trustee Semans presented the new township hall survey. The deeds now need to be prepared and the deeds can be quick claim. Trustee Herendeen moved to authorize Lynn Bowen to prepare two quick claim deeds to exchange property with the owners of the front land parcel. Treasurer Stevens second the motion. The survey cost is $800.00 plus cost for the deeds and real estate cost. Yes: All Nay: None Carried Treasurer Stevens discussed the about the resident that continually calls regarding neighbors burning. Stevens presented a copy of the rules and regulations of open burning to the board per the Chief of OMESA request. Final Comments: Opened at 8:19 pm Closed at 8:24 pm Trustee Semans made a comment that the township had $10,000.00 worth of brush cutting and spraying. He asked if anyone has noticed it around the township. He stated the following roads had some brush work and / or spraying: Shaftsburg Rd, Mc Bride Rd, Balcom Rd, Wilkinson Rd, and Dewey Rd. Karl Heckman asked about the equipment that was sold last month. He wanted to know what equipment the sexton was using. The board replied he has his own equipment.
