Call to Order:
Supervisor Herendeen called the meeting to order at 7:00 pm. Trustee Semans lead the prayer.
Board Members Present:
Supervisor Michael Herendeen, Clerk Rose Brown, Treasurer Carolyn Stevens and Trustee Richard
Semans. Trustee Gary Kiger
Guests Present: Carl Chalker, Karl Heckman, Arlene Pesik, Marlene Webster (County Commissioner),
Mike and Diane Dowler, and Corky McCreery, Road Commission: Brent Friess, Mike Constine, John
Michalec, and Troy Howes, and Deb Price.
Scheduled Comments:
County Commissioner: Marlene Webster, She introduced herself to the board. She briefed the board on
all the new appointments of the new County Commissioner board. The board has not “officially” met
yet.
Shiawassee County Road Commission: Brent Friess spoke to the board and reviewed all the proposed
road projects for Middlebury Township. There was also two joint projects with one with Fairfield
Township and one with Owosso Township. Mr. Friess continued with the Mowing and Spraying bid as
well as the mineral well brine cost and the rotation of the gradall use schedule. He continued with some
year-end stats with hours of overtime sand and salt use.
Brent Friess review stats of monies spent for road work by the township and the county prior to the gas
tax and post the gas tax. He asked the board to have a decision made by April in order to schedule
equipment.

Corky McCreery made a comment of wanting a synopsis of the minutes printed a paper.
Motion to Approve Agenda:
Kiger made a motion to add to add printing the township minutes as a synopsis in the local paper
under Business. Trustee Semans seconded the motion.

Nay: None Carried
Supervisor Herendeen made a motion to add with the addition of property exchange and marijuana
ordinance under Communication to the agenda. Trustee Semans seconded the motion.
Yes: All
Nay: None Carried
Treasurer Stevens made a motion to approve the agenda with all the additions. Trustee Semans
seconded the motion.

Motion to Approve Minutes:
Trustee Semans made a motion to approve the minutes from the December 12, 2018 with the
correction of Herendeen to Semans and the correction the word closet to closest Treasurer Stevens
seconded the motion.
Yes: All
Nay: None Carried
Motion to approve Bills:
Trustee Semans Made the motion to approve the payments of bills in an amount of $8,514.67 from
the General Fund and a check for $21,436.00 for OMESA from Emergency Service Fund. Clerk Brown
seconded the motion.
Yes: All
Nay: None Carried
The board then discussed checks that was voided and reissued due to the question of who is the
representative of Park and Recreation board. Deb Price tried to clarify the situation. The person in
question had previously lived in a different municipality and has recently moved into Middlebury
Township. It was unknown to the township board that this person was listed as a representative of
Middlebury Township. Ms. Price stated to Supervisor Herendeen that the Park and Recreation board
may be restructuring.
Herendeen made a motion to void reissued check #4977 in an amount of $55.00. Treasure Stevens
seconded the motion.

Communications:
Park and Recreation: None
OMESA: Building is up and being used. The next OMESA meeting is the fire hall. Supervisor Herendeen
reviewed about how the township was utilizing the emergency service monies. He stated about how the
emergency millage can only be spent on the emergency services.
Library: The library has the new furnace installed. Looking in purchasing new computers for public use.
MTA Meeting: Middlebury hosted the December, New Haven hosted the January, Owosso Township will
host February 5th
Assessor Communications: Diane Dowler, township assessor is trying to set the Monday, March 11th
from 3 to 9 pm Tuesday, March 12 8 to 2 pm March 5th is the organizational meeting. Diane asked if the
Board of Review has been reappointed. Gordon Taylor Dave Sovis and Jeff Swan.
Herendeen made a motion to appoint Gordon Taylor, David Sovis and Jeff Swan as members of the
Board of Review. Treasurer Stevens second the motion.

Property Exchange: Semans updated the board on the property exchange. Lynn Bowne, township
attorney, stated the present owners would like to have a property survey and title insurance. Mr. Bowne
stated the township just had a survey completed. There needs to be a clarification of the name on the
deed with present owner.
Mr. Bowne recommended not working on the marijuana ordinance until the state write the rules.
Supervisor Herendeen stated he thought there was a deadline with having ordinance with restriction or
prohibition.
Clerk Communication: Clerk asked everyone review their respective W-2 for any correction before they
need to be submitted.
Business:
1. Poverty Exemptions Guideline Resolution 2019-01
The resolution to adjust the poverty guidelines to the federal standard.
Supervisor Herendeen moved to adopt the resolution.

2. Printing Synopsis. Kiger made a motion to print the meeting minutes. Trustee Semans second
the motion.
The board discuss printing of the synopsis of minutes in the paper. Treasurer Stevens stated the
expense of the printing the minutes doesn’t equate for the amount of information printed in the
paper.

Motion failed on a 3 to 2 roll call vote.

Trustee Semans wanted to discuss the road work. He would like to take Simpson Rd off and do
all the gravel road projects. He would like to see all the gravel roads into good shape. Simpson
Rd cost by itself $124,600.00. Trustee Semans would like to have a decision done by February.
Trustee Semans also made notes on what needs to be sprayed and mowed and where the
gradall work needs to be done. Trustee Kiger stated if the board would drop Simpson Rd project
then the money could be used to add extra mineral well brine (add a third coat) to problem
roads, like Wilkinson Rd.
Treasurer Stevens stated we need to find out if the road commission will come out apply
mineral well brine on just one or two roads.
The board discussed working on different roads.
Motion to adjourn the meeting: Adjourned at 8:26 pm
Without objection the supervisor adjourned the meeting at 8:26 pm.
