Trustee Semans lead the prayer. Board Members Present: Supervisor Michael Herendeen- Arrived at 7:40 pm, Clerk Rose Brown, Treasurer Carolyn Stevens and Trustee Richard Semans. Trustee Gary Kiger Guests Present: Carl Chalker, Karl Heckman, Arlene Pesik, Susan Tomasek-Swan, Diane and Mike Dowler, Mark Holley and Bill Lasher, 7:33 Marlene Webster-arrived, 7:35 Caroline Wilson-arrived Clerk Brown made a motion to have Trustee Seman chair the meeting. Supported by Treasurer Stevens. Ayes: All Nay: None Carried Scheduled Comments: * Bill Lasher spoke about 2 parcels located in the City of Ovid that lie in Middlebury Township. Lasher would like to issue a 425 to address the issues with the two parcels. The parcels would pay taxes to Middlebury Township but still continue to receive City amenities. The two parcels 315 and 321 East Pearl. The residents would be voters of Middlebury Township. If sewer and water goes delinquent will be addressed by the attorneys there is no answer to this question. * 7:38 pm Marlene Webster spoke that Mental Health Court has begun. The County is hiring a CFO (Finance Director). Ms. Webster discussed the purpose of Mental Health Court. * 7:45 pm Caroline Wilson spoke to the board about the All Service Saturday and presented new directory. The county is looking at getting Point and Pay. The concealed pistol permit can be completed online. By 2020, everyone needs to have enhanced driver’s license. All documents must be certified documents. Changes in election, Caroline suggested to look at the invoice from November and next year will have four elections. The absent voter will change how ballots will be ordered. There has been an increase in security so more cost will be occurring. Public Comments: Opened at 7:11pm Closed at 7:15 pm Carl Chalker spoke about issue with drainage and grass growing on his property. Chalker also brought up about an issue of a water that is running behind neighbor’s property. Motion to Approve Agenda: Clerk Brown made a motion to approve the agenda with addition of computer for Treasurer and Assessor and Closed Session. Treasurer Stevens seconded the motion. Aye: All Nay: None Carried Motion to Approve Minutes: Clerk Brown made a motion to approve the minutes from the May 8, 2019 as presented. Trustee Kiger seconded the motion. Yes: All Nay: None Carried Motion to approve Bills: Trustee Kiger made the motion to approve the payments of bills in an amount of $7,911.38 from the General Fund with 4 EFT and checks numbered 5054-5067 (check 5060 voided). Emergency Fund Check 1009 in an amount of $1,132.50 and Road Fund check number 1052 in an amount of $14,760.00. Clerk Brown seconded the motion. Yes: All Nay: None Carried Communications: Park and Recreation: Trustee Kiger updated the board on the Park and Recreation. OMESA: The Open House went well. Everything is finally moved to the hall. Library: Summer Reading Program and new computers for public use. MTA Meeting: Done for the summer. Assessor Communications: Diane Dowler announced her resignation effective July 1, 2019 and recommended Mark Holley. Business: 1. Approval of Moving two parcels Clerk Brown made the motion to move forward to start the process for the transfer of the two parcels. Treasurer Stevens supported the motion. Aye: All Nay: None Carried 2. Tree Removal in Cemetery A message was left by resident of dead trees that need to be removed. Tribfelner has removed the two trees but there is one large tree that needs to be removed. Herendeen moved to seek a contract to remove the dead tree in the cemetery and authorize Trustee Semans and/ Or Supervisor Herendeen to execute the contract. Trustee Semans seconded the motion. Ayes: Kiger, Semans, Stevens, Brown, Herendeen Nays: none Carried 3. Gas Company An independent gas company approached the board about buying gas from them for a lower price. Herendeen moved to not consider changing gas company at this time. Trustee Semans supported. Aye: All Nay: None Carried 4. Marijuana Ordinance Trustee Semans presented a copy of the Marihuana Ordinance from the MTA website. Trustee Semans Moved to fill in the appropriate areas and posting of the ordinance. Trustee Kiger seconded the motion. Roll Call: Aye: Kiger, Semans, Stevens, Brown, Herendeen Nay: None Carried 5. Hall Discussion Clerk Brown has tried to contact Gene Ruess to fix the lights in the hall. 6. Land Swap Update Trustee Semans had nothing new on the land swap. The property owner wants new assurance of not being land lock. 7. Computer for Treasurer - Treasurer Stevens made a motion to allow up to $1,500.00 for the purchase of a laptop computer and software. Clerk Brown seconded the motion. Roll Call: Aye: Kiger, Semans, Stevens, Brown, Herendeen 8. Assessor- Mark Holley presented his contact to provide assessor service for the township. Herendeen suggested a clause for notice of 30 days for termination for either party of the contract. The Paragraph 10, was modified to include both parties to given notice of 30 days for termination of contract. Treasurer Stevens made the motion to sign a contract with Mark Holley to provide Assessor Services with modification to the contract. Seconded by Trustee Semans.
