REGULAR MEETING
Call to Order:
Supervisor Swan called the meeting to order at 7:00 pm.
Board Members Present:
Supervisor Jeffery Swan, Clerk Susan Tomasek Swan, Treasurer Jill Ruess, Trustee Greg Atwood- ABSENT
and Trustee Gene Ruess
Guests Present: Guests present: 12 community members including Road Commission; Deputy Clerk
Shawn Dilts; Deputy Supervisor Mike Herendeen
Scheduled Comments: Chris Cannon reviewed the proposed plan submitted to the township board. Any
quotes in black are locked in prices, quotes in red have to be put out to bid so are not locked in.
Discussion with Troy Howes regarding constituent concerns about gravel trucks on Baldwin Rd and
surrounding roads. Mr. Howes identifies that there is a contract with Owosso Township that does not
allow for this. Mr. Howes states that he will discuss with Owosso Township board regarding enforcement.
Brine applications are scheduled for May 9 & 15 and July 11 & 17.
Public Comments: Opened at 7:14 pm Closed at 7:19 pm Robin Cannon and her son, Cody, presented
information on the need for transportation through SATA for Cody who is blind. They have utilized
Transportation Solutions in the past but that service has not been consistently available. Cody would use
this service twice a day for school and would like to also obtain a job that he would use SATA for. Judy
Betts identified that her disabled husband would find it useful for medical appointments in the future.
Kimberly Deyarmond requested consideration for her elderly neighbor and her children to attend school
in Corunna.
Motion to Approve Agenda:
Clerk Tomasek-Swan made a motion to approve agenda as amended. Treasurer Ruess seconded the
motion.

Motion to Approve Minutes:
Treasurer Ruess made a motion to amend the December 13, 2022 minutes Clerk Tomasek-Swan
seconded the motion.

Motion to approve Bills
Clerk Tomasek-Swan made a motion to approve financial reports and payment of bills and from General
Funds in the amount of $10,023.54 with checks #5866-5883 2EFTs and Emergency Fund $1,552.50 ck
1048. Trustee Ruess seconded the motion.

Communications:
MTA- No meeting due to number of ill members. Paperwork from MTA is included in the board packets.
Library- New security cameras are installed in the exterior and interior.
OMESA- No major reports.
Clerk- Increase in Ambulance service. Census is now 1650 at $3.00 per resident. W-2s are available and
distributed.
Assessor- Review of resolution. Assessor will post notice in the newspaper.
Business:
1. SATA $5,000 for FY 10/1-9/30. If adopted, they will prorate ($2,000) for initiating during the
middle of the FY. Supervisor Swan will communicate with SATA and they will be invited to
February meeting to discuss and answer questions. Possible to trial it from April to October.
2. Treasurer Bonding Insurance MTA meetings have been adamant about additional bonding
insurance. Township will review with an attorney who specializes in this area. Supervisor Swan
will follow up.
3. State Land Bank Township received letter from State Land Bank about a piece of property that
was owned by them in 2019. When this situation occurs, this requires the township to pay
50% of taxes for 5 years. The letter identified that Middlebury Township is delinquent for tax
years 2020 and 2021 and will owe for 2022. Supervisor Swan will contact MTA for consult.
4. Cemetery Sign defer to February meeting due to Trustee Atwood’s absence.
5. Set Budget Hearing for March 14th at 6:45 pm Clerk Tomasek-Swan made a motion to set the
budget hearing for March 14, 2023 at 6:45 pm and will post. Treasurer Ruess seconded the
motion. Voice Vote: Ayes: All Nays: None Absent: Atwood Carried
6. Annual Conference it is scheduled for April 17-20, 2023 in Traverse City. Supervisor Swan is
interested in attending. Clerk Tomasek-Swan will discuss with Trustee Atwood regarding his
interest. Clerk Tomasek-Swan made a motion to send up to 3 board members to the annual
conference, with hotel expenses and mileage. Treasurer Ruess seconded motion.

7. Resolution 2023-01
March Board of Review
Alternative Starting Date
Resolution 2023-01
WHEREAS, Public act 194 2003, allows the township board by resolution to select an alternative starting
date in March when the board of review shall initially meet.
WHEREAS, MCL 211.30 provides an alternative starting date of Tuesday following the second Monday of
March.
WHEREAS, The assessor availability to assist the Board of Review on that day shall be the reason for
selecting Tuesday March 14, 2023.
NOW, THEREFORE, BE IT RESOLVED that Middlebury Township approves the Board of Review meeting
on the second Tuesday of March in 2023.
At a regular meeting of the Middlebury Township held on the 10th day of January 2023, board member
Clerk Tomasek-Swan moved for adoption of the foregoing resolution and board member Trustee Ruess
supported the motion.
Voting for: Treasurer Ruess, Trustee Ruess, Clerk Tomasek-Swan, Supervisor Swan
Voting Against: None
Absent: Atwood
Resolution declared adopted.
