Call to Order
Clerk Tomasek Swan called the meeting to order at 6:45 pm.
Election Commission Board members present:
Clerk Tomasek Swan, Supervisor Jeff Swan and Treasurer Jill Ruess
Guests Present: There were 2 people present at the meeting.

Motion to Approve Agenda: Supervisor Swan made a motion to approve the agenda as presented, Clerk
Tomasek-Swan second the motion.
Carried on voice vote.
Business:
1. Resolution 2023-03 Consolidation of Owosso School District Voters with Owosso Charter
Township for the August 8, 2023 Election
Resolution 2023-03
Resolution to Consolidate Owosso School District Voters with Owosso Charter Township for the
August 8, 2023 Election
WHEREAS, the Township Clerk is responsible for conducting elections in Middlebury Township;
and
WHEREAS, MCL 168.659 provides the Election Commission of city, township, or county to set up
temporary consolidated precincts for special school elections;
WHEREAS; the township of Middlebury has 28 registered voters in the Owosso School district
and the clerk of Owosso Charter Township has agreed.

WHEREAS; Owosso Charter Township located at 401 S. Delaney Rd., Owosso, Michigan 48866
is a neighboring Owosso School district jurisdiction.
NOW THEREFORE, BE IT RESOLVED:
The Middlebury Township Election Commission authorizes the temporary consolidation of
Owosso school district voters and the change of voting location to Owosso Charter Township at
401 S. Delaney Rd., Owosso, MI 48867.

Upon Roll call vote the following voted Aye: Treasurer Ruess, Clerk Tomasek-Swan, Supervisor

The Clerk declares this resolution adopted.
Without Objection the Clerk adjourned the meeting at 6:48 pm
REGULAR MEETING
Call to Order:
Supervisor Swan called the meeting to order at 7:00 pm.
Board Members Present:
Supervisor Jeffery Swan, Clerk Susan Tomasek Swan, Treasurer Jill Ruess, Trustee Greg Atwood, and
Trustee Gene Ruess
Guests Present: 2 Guests were present as well as Shawn Dilts, Deputy Clerk; Mike Herendeen, Deputy
Supervisor.
Scheduled Comments: County Commissioner not present.
Public Comments: Opened at 7:01 pm Closed at 7:08 pm Resident, Mark Darling, thanked board for the
installation of the new sign for the cemetery. He also identified that there are three House Bills being
presented regarding local control of storage and crushing of sand and gravel. These are House Bills are
45-26, 45-27, and 45-28. He also identified that our Representative Begole has a public meeting on
5/15/2023 at 6-7:30 pm regarding gun legislation at the Shiawassee Conservation Club.
Motion to Approve Agenda:
Clerk Tomasek-Swan made a motion to approve agenda as amended. Trustee Atwood seconded the
motion.

Motion to Approve Minutes:
Clerk Tomasek Swan made a motion to amend the April 11, 2023 minutes with the correction of the
dollar amount regarding the SATA full year quote being an approximation but likely higher and the
correction of Diane Aldrich last name. Trustee Ruess seconded the motion.
Carried on voice vote.
Motion to approve Bills
Clerk Tomasek-Swan made a motion to approve bills from General Funds in the amount of $11,284.65
with checks #5939-5952 and 1 EFTs with Daystarr included. Trustee Atwood seconded the motion.

Communications:
MTA- Supervisor reported that there was not a local MTA meeting. He did attend the statewide MTA
conference and discussed the information learned on statewide issues, especially related to new election
laws and solar panels.
Library- Clerk Tomasek-Swan reported staff asking for pay raises and one staff out on FML (Family
Medical Leave). Minutes included in packet.
OMESA- Supervisor presented the appropriation check to OMESA board. He shared their expressed
gratitude to the Middlebury Board members. OMESA is still waiting for the refurb quotes on one of their
engines.
Clerk- Clerk Tomasek-Swan reported that Owosso School District has an Election on August 8, 2023.
Middlebury Township has 28 voters and have established an agreement with Owosso Township to have
Middlebury Township voters to utilize Owosso Township to vote. New cemetery sign installed on May 1,
2023. The section signs will be installed soon.
Assessor- Not present
Business:
2. Township Mowing- Supervisor Swan presented information on challenges for the mowing from
our current vendor due to ground unevenness and gravel in the grass. Options discussed
regarding leveling the ground and cleaning up the gravel. The township is going to reshape the
mound hill so that the current provider can mow it.
3. Tablets Review of the information packets that were sent to Board members in April 2023.
Board members are currently desiring to remain with current system. This item is tabled for
now.
4. NSF Resolution Supervisor consulted with Attorney McKone regarding the NSF issue and the
current inaccurate status that the county rolls identified that the property taxes were paid on

that property. Attorney is working with the county on this issue. Township will need to send
another letter to the property owner regarding the NSF status, but we are awaiting the
verbiage from the attorney for the letter.
5. Treasurer Insurance Bond-Attorney’s Opinion has identified that the county is responsible for
the cost of this insurance. There is no resolution on this to date. Options discussed regarding
next steps to address the county assuming the responsibility for the cost of this bond insurance.
Supervisor will follow up with Attorney McKone and Dr. Boggs (county administrator). Clerk
Tomasek Swan is following up with insurance company and request a quote packet.
